বাটোয়ারা মামলা — শরিকদের জমি ভাগ Partition suits — dividing shared land

গ্রামের বহু পরিবারে জমি আছে অথচ কারও নামে আলাদা করে কিছু নেই — বাবার নামে রেকর্ড, ভাইয়েরা মিলে ভোগ করছেন, কেউ চাষ করছেন, কেউ শহরে থাকেন। বছরের পর বছর এভাবেই চলে। সমস্যা শুরু হয় যেদিন কারও টাকার দরকার পড়ে, বা কেউ মারা যান, বা কেউ নিজের অংশটুকু বিক্রি করতে চান।

ভাগ না হলে যা যা আটকে যায়

- নিজের অংশ বিক্রি করা কঠিন, ক্রেতা ঝামেলা এড়াতে চান
- ব্যাংকে বন্ধক রেখে ঋণ নেওয়া যায় না
- নামজারি করা যায় না, ফলে খাজনাও নিজের নামে দেওয়া যায় না
- এক শরিক ঘর তুললে বা গাছ কাটলে বাকিরা আপত্তি করেন, বিরোধ বাড়ে

আপসে ভাগ, নাকি আদালতে

সব শরিক রাজি থাকলে আপসেই ভাগ হতে পারে, এবং সেটিই দ্রুততম ও সবচেয়ে কম খরচের পথ। এক্ষেত্রে ভাগের বিষয়টি দলিলে লিখিতভাবে থাকা জরুরি — মুখের ভাগ কয়েক বছর পর আবার বিরোধে ফিরে আসে।

কেউ রাজি না হলে, বা কেউ অংশ দিতে অস্বীকার করলে, তখন আদালতে বাটোয়ারা মামলা করতে হয়।

যা লাগবে

- জমির দলিল
- খতিয়ানের কপি — যতগুলো রেকর্ড আছে
- ওয়ারিশ সনদ, উত্তরাধিকার সূত্রে পাওয়া হলে
- খাজনার দাখিলা
- শরিকদের নাম ও ঠিকানার তালিকা

যে ভুলগুলো দেখি

সব শরিককে মামলায় পক্ষ না করা। একজন বাদ পড়লে পরে পুরো ভাগ নিয়ে আবার প্রশ্ন ওঠে।

দখল আর মালিকানা গুলিয়ে ফেলা। বহু বছর দখলে থাকা মানেই মালিকানা নয়, আবার কাগজে নাম থাকা মানেই দখল নয় — আদালতে দুটোই আলাদা করে দেখতে হয়।

আর সবচেয়ে বেশি যেটা দেখি — বিরোধ পাকিয়ে যাওয়ার পর আসা। শুরুতেই কাগজপত্র গুছিয়ে বসলে অনেক পরিবার মামলা ছাড়াই মিটিয়ে ফেলতে পারতেন।

কখন আসবেন

জমি বিক্রির চিন্তা করার আগে, বা পরিবারে ভাগ নিয়ে প্রথম কথা ওঠার সময়েই। কাগজ দেখে বলে দেওয়া যায় ভাগটা আপসে সম্ভব কি না — এতেই অনেক সময় ও টাকা বাঁচে।

Plenty of village families own land with nothing standing in any one name — the record is in the father's name, the brothers hold it between them, one farms it, another lives in town. Years pass like that. The trouble starts the day somebody needs money, or somebody dies, or somebody wants to sell their share.

What stays blocked while the land is undivided

- Selling your share is hard; buyers avoid the complication
- The land cannot be mortgaged for a bank loan
- Mutation cannot be done, so the land tax cannot be paid in your own name
- One co-sharer builds a house or fells a tree, the others object, and the quarrel grows

By agreement, or through the court

If every co-sharer agrees, the land can be divided between them, and that is by far the quickest and cheapest road. The division has to be put in writing in a deed — a division agreed only in conversation comes back as a dispute a few years later.

Where someone will not agree, or refuses to give up a share, a partition suit in court is what remains.

What you will need

- The deed to the land
- Copies of the khatian — every record that exists
- The succession certificate, where the land came by inheritance
- Land tax receipts
- A list of the co-sharers with their names and addresses

Mistakes I see

Leaving a co-sharer out of the suit. Miss one and the whole division can be reopened afterwards.

Confusing possession with ownership. Years of possession do not by themselves make you the owner, and a name on paper does not by itself mean possession. A court looks at the two separately.

And the one I see most — coming after the quarrel has set hard. Many families could have settled without a suit at all if the papers had been put in order at the start.

When to come

Before you start thinking about selling, or as soon as division is first raised in the family. Looking at the papers is enough to say whether a division by agreement is possible — and that alone saves a great deal of time and money.
