দেনমোহর ও ভরণপোষণ Dower and maintenance

পারিবারিক আদালতের মামলায় সবচেয়ে বেশি যে দুটি শব্দ শুনি, সেই দুটিই মানুষ সবচেয়ে বেশি গুলিয়ে ফেলেন — দেনমোহর আর ভরণপোষণ। অনেকে ভাবেন একটি পেলে অন্যটি আর পাওয়া যায় না। কথাটা ঠিক নয়, আর এই ভুল ধারণার কারণে অনেক নারী নিজের প্রাপ্য না চেয়েই চলে যান।

দুটি আলাদা জিনিস

দেনমোহর হলো বিয়ের সময় স্ত্রীর জন্য নির্ধারিত অর্থ বা সম্পদ, যা কাবিননামায় লেখা থাকে। এটি স্ত্রীর নিজের অধিকার — দয়া বা উপহার নয়।

ভরণপোষণ হলো চলার খরচ — খাওয়া, থাকা, চিকিৎসা, সন্তানের খরচ। এটি সময়ের সঙ্গে চলতে থাকা বিষয়।

সহজ করে বললে, দেনমোহর একটি নির্দিষ্ট পাওনা, আর ভরণপোষণ চলমান দায়িত্ব।

কাবিননামাই মূল কাগজ

কাবিননামায় দেনমোহরের অঙ্ক লেখা থাকে, আর কতটা তাৎক্ষণিক (মোহরানা আদায়) আর কতটা বাকি রইল সেটিও থাকে।

অনেক পরিবারে কাবিননামা হারিয়ে যায় বা কারও কাছে আটকে থাকে। সেক্ষেত্রে নিকাহ রেজিস্ট্রারের অফিস থেকে নকল তোলা যায়।

যা লাগবে

- কাবিননামা বা তার নকল
- জাতীয় পরিচয়পত্র
- সন্তানের জন্ম নিবন্ধন, সন্তানের বিষয় থাকলে
- স্বামীর আয়ের ধারণা দেওয়ার মতো কিছু থাকলে — চাকরির কাগজ, ব্যবসার তথ্য
- আগে কোনো নোটিশ বা সালিশ হয়ে থাকলে তার কাগজ

যে ভুলগুলো দেখি

মুখের কথায় ভরসা করা। "সব মিটমাট হয়ে গেছে" বলে অনেকে কাগজে কিছু রাখেন না, পরে কিছুই প্রমাণ করা যায় না।

দেরি করা। সময় যত যায়, সাক্ষী ছড়িয়ে পড়েন, কাগজ হারায়, আর পক্ষগুলো অবস্থান বদলান।

আর সন্তানকে দর কষাকষির উপকরণ বানানো। আদালত সন্তানের কল্যাণ কী তাতেই সবচেয়ে বেশি গুরুত্ব দেন, বাবা-মায়ের রাগ-অভিমানে নয়।

কখন আসবেন

পরিবারে বিষয়টি ঠান্ডা মাথায় মেটানোর চেষ্টা করে দেখুন — সেটিই ভালো। কিন্তু আলোচনা ভেঙে গেলে, বা এক পক্ষ কথা রাখছেন না বুঝলে, দেরি না করে পরামর্শ নিন। প্রথম কথাবার্তায় আপনার হাতে কী আছে আর কী নেই, সেটুকু অন্তত পরিষ্কার হয়ে যাবে।

The two words I hear most often in the family court are the two that people most often confuse — dower and maintenance. Many believe that getting one rules out the other. It does not, and because of that belief a good many women walk away without asking for what is theirs.

Two different things

Dower is the money or property settled on the wife at the time of marriage and written into the kabinnama. It belongs to her by right. It is not a favour and not a gift.

Maintenance is the cost of living — food, a roof, medical care, what the children need. It runs on over time.

Put simply: dower is a fixed debt, maintenance is a continuing duty.

The kabinnama is the document that matters

It records the amount of the dower, and how much of it was prompt and how much was left deferred.

In many families the kabinnama goes missing, or is held by someone who will not part with it. A certified copy can be obtained from the office of the nikah registrar.

What you will need

- The kabinnama, or a certified copy of it
- National ID
- The children's birth registration, where children are involved
- Anything that shows what the husband earns — employment papers, business details
- Papers from any earlier notice or arbitration

Mistakes I see

Relying on what was said aloud. "It has all been settled" — and nothing is put on paper, so later nothing can be proved.

Delay. As time passes witnesses scatter, papers are lost, and both sides harden.

And using a child as a bargaining chip. The court weighs the welfare of the child above everything else, not the anger between the parents.

When to come

Try to settle it calmly within the family first — that is the better road. But once the talking breaks down, or one side stops keeping their word, take advice without waiting. Even the first conversation will make clear what you hold and what you do not.
