জমি কেনার আগে দলিল ও খতিয়ান যাচাই Checking the deed and record before buying land

চেম্বারে আসা জমি-সংক্রান্ত মামলার একটা বড় অংশ ঠেকানো যেত — কেনার আগে দুটো দিন সময় নিয়ে কাগজগুলো দেখলেই। বাস্তবে হয় উল্টোটা। দাম ঠিক হয়, বায়না দেওয়া হয়, তারপর কেউ বলেন "কাগজটা একবার দেখিয়ে নিন" — ততক্ষণে টাকা হাতছাড়া।

বিক্রেতার নাম কাগজে আছে কি না

প্রশ্নটা সবচেয়ে সহজ, অথচ গোলমালের বেশির ভাগ এখান থেকেই শুরু হয়। যিনি বিক্রি করছেন, সরকারি রেকর্ডে তাঁর নাম আছে কি না দেখুন। হাতে দলিল থাকা আর রেকর্ডে নাম থাকা এক জিনিস নয়।

জমি উত্তরাধিকারসূত্রে পাওয়া হলে দেখতে হবে সব ওয়ারিশ বিক্রিতে রাজি কি না। একজন ওয়ারিশ বাদ পড়লে তিনি পরে মামলা করতে পারেন — তখন টাকা আপনার গেছে, আর আপনি কয়েক বছর আদালতে।

যে কাগজগুলো নিজেই দেখতে পারেন

- মূল দলিল ও তার আগের দলিল — জমিটা বিক্রেতার হাতে কীভাবে এল
- খতিয়ান — যতগুলো রেকর্ড আছে, সবগুলো
- সর্বশেষ খাজনার দাখিলা
- নামজারির কাগজ
- মৌজা ও দাগ নম্বর দলিলের সঙ্গে মিলছে কি না

জমি বন্ধক বা মামলায় আছে কি না

অনেক সময় ব্যাংকে বন্ধক রাখা জমি বিক্রি হয়ে যায়, ক্রেতা জানতেও পারেন না। জমি নিয়ে আগে থেকে কোনো মামলা চলছে কি না, সেটাও দেখা দরকার। এই দুটো জিনিস দলিলের গায়ে লেখা থাকে না — খোঁজ করে বের করতে হয়।

যে ভুলগুলো দেখি

বায়নানামা না লিখে পুরো টাকা দিয়ে দেওয়া। লিখিত বায়নানামা না থাকলে টাকা ফেরত পাওয়া কঠিন।

আত্মীয়তার খাতিরে কাগজ না দেখা। পরিচিতজনের কাছ থেকে কেনা জমি নিয়েই সবচেয়ে বেশি ঝামেলা হয়, কারণ প্রশ্ন করতে সংকোচ লাগে।

দলিল রেজিস্ট্রি হওয়ার পর নামজারি না করা। রেজিস্ট্রিই শেষ কাজ নয় — সরকারি রেকর্ডে নাম না উঠলে জমি আপনার নামে নয়।

কখন আসবেন

টাকা দেওয়ার আগে। কাগজ দেখে এক ঘণ্টার মধ্যেই বলা যায় জমিটায় ঝুঁকি আছে কি না। কেনার পরে যে খরচ আর ভোগান্তি হয়, তার তুলনায় এটা কিছুই নয়।

A large share of the land cases that come to my chamber could have been prevented — by taking two days to look at the papers before buying. In practice it goes the other way round. The price is agreed, the earnest money is paid, and only then does somebody say "you should have the papers checked" — by which time the money has gone.

Is the seller's name on the record

The simplest question, and the source of most of the trouble. Look at whether the person selling is named in the government record. Holding a deed and being named in the record are not the same thing.

Where the land came by inheritance, check that every heir agrees to the sale. An heir who is left out can sue later — and then your money is gone and you are in court for years.

Papers you can check yourself

- The deed, and the deed before it — how the land came into the seller's hands
- The khatian — every record that exists, not only the latest
- The most recent land tax receipt
- The mutation papers
- Whether the mouza and plot numbers match the deed

Whether the land is mortgaged or under suit

Land mortgaged to a bank is sold more often than people think, and the buyer never knows. Whether a case over the land is already pending needs checking too. Neither shows on the face of the deed; both have to be looked for.

Mistakes I see

Paying the whole price with no written bayna. Without one, getting the money back is hard.

Not examining the papers because the seller is a relation. Land bought from people we know causes the most trouble, precisely because asking questions feels rude.

Stopping at registration and never applying for mutation. Registration is not the end of the job — until the government record carries your name, the land is not in your name.

When to come

Before you part with any money. An hour with the papers is enough to say whether the land carries a risk. Set against what it costs to put right afterwards, that is nothing.
