পরিবারের একজন গ্রেফতার হলে বাড়ির লোক যে অবস্থায় চেম্বারে আসেন, সেটা বর্ণনা করা কঠিন। হাতে কোনো কাগজ থাকে না, কে কী বলেছে তার ঠিক থাকে না, আর সবাই একটাই কথা বলেন — "আজকেই বের করে আনতে হবে।" এই লেখাটা সেই মুহূর্তের জন্য।
জামিন মানে মামলা শেষ নয়
প্রথমেই এই ভুল ধারণাটা পরিষ্কার করা দরকার। জামিন পাওয়া আর মামলা থেকে খালাস পাওয়া এক জিনিস নয়।
জামিন মানে বিচার চলাকালীন আসামি হাজতে না থেকে বাইরে থাকতে পারবেন, এই শর্তে যে তিনি নির্ধারিত তারিখে আদালতে হাজির হবেন। মামলা তার নিজের গতিতে চলতেই থাকে। জামিন পাওয়ার পর হাজিরা না দিলে জামিন বাতিল হয়ে যায়, এবং তখন অবস্থা আগের চেয়ে খারাপ হয়।
কোন আদালতে
এটি নির্ভর করে মামলাটি কোন পর্যায়ে আছে এবং অভিযোগ কী তার উপর।
যা সঙ্গে আনবেন
- এজাহার বা মামলার নম্বর, জানা থাকলে
- থানার নাম ও মামলার তারিখ
- গ্রেফতার হয়ে থাকলে ধৃতের নাম ও কোথায় আছেন
- আসামির জাতীয় পরিচয়পত্রের কপি
- আগে একই বিষয়ে কোনো মামলা থাকলে তার তথ্য
কাগজ না থাকলেও আসবেন। মামলার নম্বরটুকু জানা থাকলেই বাকিটা বের করা যায়।
যে ভুলগুলো বেশি দেখি
দালালের হাতে টাকা দেওয়া। থানা বা আদালত চত্বরে অনেকে "জামিন করিয়ে দেব" বলে টাকা নেন। জামিন দেন কেবল আদালত, আর কেউ নয়।
দ্বিতীয় ভুল — তাড়াহুড়ায় ভুল তথ্য দেওয়া। আতঙ্কে পড়ে অনেকে ঘটনার কিছু অংশ চেপে যান। আইনজীবীর কাছে পুরো কথা না বললে আদালতে গিয়ে বিপদ হয়।
কখন আসবেন
যত দ্রুত সম্ভব। গ্রেফতারের খবর পাওয়ামাত্র। প্রথম কয়েক ঘণ্টায় কোন আদালতে কীভাবে দাঁড়াতে হবে সেটি ঠিক করা গেলে পরের দিনগুলো অনেক সহজ হয়।
It is hard to describe the state a family arrives in when one of them has been arrested. Nobody has a paper in hand, nobody is sure who said what, and everyone says the same thing — "he has to come out today." This is written for that moment.
Bail is not the end of the case
This confusion is worth clearing up first. Being granted bail is not the same as being acquitted.
Bail means the accused stays out of custody while the trial runs, on the condition that he appears in court on the dates fixed. The case carries on at its own pace. Miss a date after bail is granted and the bail is cancelled — and the position is then worse than it was before.
Which court
That depends on the stage the case has reached and on what the charge is.
What to bring
- The FIR or case number, if you know it
- The name of the police station and the date of the case
- The name of the person arrested and where they are being held
- A copy of the accused's national ID
- Details of any earlier case on the same matter
Come even if you have none of it. The case number alone is usually enough to trace the rest.
Mistakes I see most often
Paying a tout. People wait around police stations and court premises offering to "get the bail done". Only a court grants bail. Nobody else can.
The second is giving hurried, incomplete information. Frightened people leave parts of the account out. If your lawyer does not have the whole story, the trouble surfaces in court.
When to come
As soon as you can — the moment you hear of the arrest. Settling which court to go to, and how the application should be put, in those first few hours makes the days that follow far easier.
